In a recent Bloomberg Surveillance interview, Veda Partners director of economic policy Henrietta Treyz highlighted the fragile legal footing of the White House’s tariff strategy. She explained that a pending appeals court case could determine whether the president has the authority under the International Emergency Economic Powers Act (IEEPA) to maintain tariffs on countries such as India.
With the entire framework of tariffs tethered to IEEPA, a loss in court would force a dramatic policy shift. Treyz noted that the administration may already be hedging its bets—recently launching new Section 232 and 301 trade investigations into furniture and turbines. Unlike IEEPA, these statutes face fewer legal challenges, suggesting a backup plan is in motion should the IEEPA authority be struck down.
